Terms of Service | Triangle Landscapers

These Terms of Service ("Terms") govern your use of trianglelandscapers.com (the "Site"), operated by Triangle Landscapers ("we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. What Triangle Landscapers Is

Triangle Landscapers is a directory and marketplace connecting homeowners in the Raleigh-Durham-Cary area ("Triangle") with independent landscaping businesses. We are not a landscaping company, we do not perform landscaping work ourselves, and we are not a party to any agreement between a homeowner and a landscaping business.

2. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to use the Site.
Homeowner accounts let you request quotes and track bids on your projects. Business accounts let a landscaping business claim and manage its listing. Both require accurate information; you're responsible for keeping your login credentials confidential and for all activity under your account.
Business listing claims are not automatic. Every claim is manually reviewed and approved or rejected by our administrators before the business gains control of its listing, regardless of whether identity verification (Section 6) has been completed.

3. Homeowner Use of the Site

Requesting quotes is free for homeowners. You may optionally name a starting bid amount, a bid deadline, and preferred project dates.
Landscaping businesses may submit bids on your project. Some bids show anonymously (amount and the business's public rating only) until either the business or you pays a fee to reveal full identity and contact information.
We do not guarantee that any business will bid on your project, that a bid will be accurate or honored, or that work performed by any business will meet a particular standard. You are solely responsible for vetting and contracting with any business you choose to work with.
Photos, videos, and project details you upload should depict your own property and project. Do not upload content that is unlawful, infringes on someone else's rights, or contains sensitive information about other people without their consent.

4. Business Use of the Site

Claiming a listing requires accurate business and contact information, subject to manual admin approval.
Placing a bid on a homeowner's project requires payment of a bid fee, charged via Stripe at the time of bidding. Bid fees are non-refundable once a bid is successfully submitted, regardless of whether the homeowner accepts it.
Reveal fees (paid by either the business or the homeworkowner — whichever pays first) unlock full identity and contact information for a specific bid and are non-refundable once the reveal is processed.
Any insurance, bonding, or licensing information and documents you submit must be accurate and current. We manually review submissions, but a "Verified" badge reflects only that we reviewed the documents you provided — it is not a guarantee, endorsement, or ongoing confirmation of your coverage.
Identity verification is performed by Stripe Identity and requires a one-time fee, charged via Stripe. This is separate from and in addition to our manual claim review.
You are solely responsible for the accuracy of your bids, the quality and legality of your work, holding any required licenses and insurance, and your own tax and business obligations.

5. Fees and Payments

All payments on the Site (bid fees, reveal fees, identity verification fees) are processed by Stripe. Fee amounts are shown before you pay. Except where required by law, fees are non-refundable once the associated action (bid submission, reveal, or verification) completes successfully. We may change fee amounts at any time; changes apply to actions taken after the change.

6. Identity Verification

Stripe Identity verification is a supplemental trust feature. Documents you submit go directly to Stripe under Stripe's own terms and privacy policy — we do not receive or store them. A completed verification reflects Stripe's assessment at a point in time and does not guarantee a business's future conduct, licensing, insurance, or the quality of its work.

7. Reviews and Ratings

Ratings and reviews shown on business listings are sourced from Google and reflect Google's own data and policies, not ours. We do not verify the accuracy of third-party reviews and are not responsible for their content.

8. Prohibited Conduct

You agree not to:

Provide false or misleading information in a project request, bid, business claim, or verification submission
Use the Site to harass, defraud, or misrepresent yourself to another user
Attempt to circumvent the bidding, reveal, or fee mechanisms of the Site
Scrape, reverse-engineer, or interfere with the Site's normal operation
Upload content that is unlawful, infringing, or that you don't have the right to share

9. Disclaimer of Warranties

The Site and all information on it are provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any business listed will perform work satisfactorily, hold valid licensing or insurance, or honor any bid. You use the Site, and engage with any business found through it, at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law, Triangle Landscapers and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data, arising from your use of the Site or any transaction or interaction with a business or homeowner facilitated by the Site. Our total liability for any claim arising from the Site will not exceed the amount, if any, you paid to us in the twelve months before the claim arose.

11. Indemnification

You agree to indemnify and hold Triangle Landscapers harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your interactions with other users.

12. Termination

We may suspend or terminate your account at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users or the Site. You may stop using the Site and request account deletion at any time.

13. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in North Carolina.

14. Changes to These Terms

We may update these Terms from time to time. We'll update the "Last updated" date above when we do. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
